Nach Abstimmung mit den obersten Finanzbehörden der Länder gilt Folgendes:
Regelungen zur Umsatzsteuervergünstigungen auf Grund des Ergänzungsabkommens zum
Protokoll über die NATO-Hauptquartiere und zur Anwendung der Umsatzsteuerbefreiung
nach § 4 Nr. 7 Satz 1 Buchstabe d UStG
(1) Auf Grund des Artikels 14 Abs. 2 des Ergänzungsabkommens zum Protokoll über die
NATO-Hauptquartiere (BGBl. 1969 II S. 2009) sind Lieferungen und sonstige Leistungen, die ein
Hauptquartier ausführt, sowie Lieferungen und sonstige Leistungen an ein Hauptquartier unter
bestimmten Voraussetzungen von der Umsatzsteuer befreit. Die Voraussetzungen für diese
Umsatzsteuerbefreiungen entsprechen weitgehend den Voraussetzungen für die
Umsatzsteuerbefreiungen nach Artikel 67 des Zusatzabkommens zum NATO-Truppenstatut. Die

Abschnitte B, C, E bis G und I des BMF-Schreibens vom 22. Dezember 2004 - IV A 6 - S 7492
13/04 - (BStBl I S. 1200) sind daher sinngemäß anzuwenden.

(3) Lieferungen, ausgenommen Lieferungen neuer Fahrzeuge im Sinne des § 1b Abs. 2 und 3
UStG, und sonstige Leistungen an die in dem Gebiet eines anderen Mitgliedstaates ansässigen
zwischenstaatlichen Einrichtungen sowie deren Mitglieder sind unter den weiteren
Voraussetzungen von § 4 Nr. 7 UStG nach § 4 Nr. 7 Satz 1 Buchstabe d UStG von der
Umsatzsteuer befreit. Zu den zwischenstaatlichen Einrichtungen in diesem Sinne gehören auch
die NATO-Hauptquartiere.
Im übrigen Gemeinschaftsgebiet ansässige Hauptquartiere im Sinne von Artikel 1 des Protokolls
über die NATO-Hauptquartiere (BGBl. 1969 II S. 2000) sind:
